In Nevada, a child custody arrangement can be determined in one of two ways: either through a mutual agreement between the parents, or through the courts. If your child custody case is brought to court, then there are a number of ways that it can turn out. The courts treat every case as unique, taking into consideration the individual circumstances, needs, and people involved. Since child custody arrangements can vary widely, it is important to have a child custody attorney by your side to argue your case.
Depending on the family situation, the details of each child custody case can differ dramatically. However, generally speaking, Nevada recognized two main types of child custody:
Physical custody determines who the child will live with. If a parent has sole physical custody, that means the child lives with that parent at least 60% of the time. However, if parents have joint physical custody, that means the child spends at least 40% of their time with each parent.
Legal custody focuses on the decisions that parents make regarding their child’s upbringing. It can include decisions made about what school they attend, what religion they practice, and what kind of medical treatment they receive. Sole legal custody means that one parent is responsible for these decisions, while joint legal custody means that parents share responsibility for these decisions. In most cases, a court will award joint legal custody, even if a parent doesn’t have joint physical custody.
