The Automatic Stay and Discharge Injunction

When you file for Bankruptcy, the court enters an order called the automatic stay. This stay is effective upon the filing of your bankruptcy and stops most, if not all, creditors from collecting from you and/or filing suit against you. The automatic stay gives debtors a breathing spell from collection efforts, evictions, the garnishment of wages etc.  Creditors, however, could file a motion to lift the stay and to resume their collection efforts. This most likely happens if the debtor is not current with payments on his/her vehicle or house. If you are not current with payments, the creditor could then repossess the asset. 


A bankruptcy discharge releases the debtor from personal liability for certain types of debts. The court usually enters a discharge about 60 days after the meeting of creditors. Once the debtor receives a discharge, the debtor is no longer required to pay that debt. The discharge is a permanent order prohibiting creditors from taking any form of action that attempts to collect the debt. This includes sending debts collection letters, calling the debtor, filing suit against the debtor etc.
