If you are no longer able to pay your debts, then Chapter 7 bankruptcy is a way to free yourself of that debt in as little as a few months. Unlike other types of bankruptcies, Chapter 7 does not create a plan of repayment. Instead, a trustee is chosen to sell any of your nonexempt assets (any property other than your primary home) to pay back your creditors.

Chapter 7 is a means-test bankruptcy, meaning that a court will study your income, expenses, and family size to determine if you have a reasonable amount of income to pay off your debts.
